Lord Portarlington v. Soulby
Court of Chancery
40 Eng. Rep. 40 (1834)
- Written by Eric Miller, JD
Facts
Lord Portarlington (plaintiff) accepted a bill of exchange payable to certain wine merchants (defendants), but the bill was invalid due to an illegal consideration. Although the parties were apparently residents of England, the merchants sought to sue Lord Portarlington for payment in Ireland. Lord Portarlington obtained an injunction from an Irish court to prevent the merchants from suing. The merchants moved the English Court of Chancery to dissolve the injunction.
