Facts
Lord (plaintiff) was at a hospital receiving treatment for a spinal cord injury suffered in an automobile accident. Allegedly, her doctor, Lovett (defendant), misdiagnosed her injury, causing Lord to lose the opportunity for a significantly more favorable recovery. Lord brought a medical malpractice claim against Lovett, claiming that Lovett’s negligence deprived Lord of a better result. However, Lord was unable to quantify the extent to which Lovett deprived her of a better result. The trial court dismissed the case, noting that Lord could not recover damages for lost opportunity alone.
