Facts

Jack Lorraine (plaintiff) owned a boat that was struck by lightning. Lorraine had insurance on the boat and filed a claim with the insurer, Markel American Insurance Company (Markel) (defendant). Markel reimbursed Lorraine for some but not all the claimed damage to the boat. The parties took the dispute to an arbitrator, and the arbitrator issued an award to Lorraine. Lorraine sued Markel to enforce the arbitrator’s decision. Both parties moved for summary judgment and attempted to support their motions with electronically stored information (ESI).
