Facts
Louis Vuitton Malletier (Louis) (plaintiff) introduced handbags bearing the Monogram Multicolore mark. The handbags had a white or black background with the intertwined initials LV set in various colors. Subsequently, Dooney & Bourke, Inc. (Dooney) (defendant) introduced Dooney’s It Bag handbags. Dooney’s handbags had a white or black background with the interlocking initials DB set in various colors. Louis filed claims in the United States District Court for the Southern District of New York, alleging trademark infringement and trademark dilution. For the trademark-infringement claim, the district court found the Monogram Multicolore mark was valid but there was no likelihood of confusion with Dooney’s handbags. Louis appealed. The appeals court affirmed that the Monogram Multicolore mark was valid. Dooney filed motions for summary judgment in the district court on the trademark-infringement and trademark-dilution claims.
