Facts
Louise Caroline Nursing Home, Inc. (Caroline) (plaintiff) sought damages for breach of a contract under which Dix Construction Corp. (Dix) (defendant) agreed to construct a nursing home. The case was referred to an auditor, who determined that Dix had breached the contract by not completing the project within the specified time. The auditor also found, however, that Caroline had suffered no damages and that the cost to complete the nursing home was within the contract price. Caroline appealed.
