Facts
The Sokolows (defendants) were a young family with two small children living in an apartment building in Queens, New York. During their lease, the Levins, a middle-aged couple, moved into the apartment below them. Soon thereafter, the Levins complained of the noise from the Sokolows’ apartment, stating that it was disturbing their enjoyment of their apartment. The Sokolows insisted that the noise was no more than that to be expected from daily living. The landlord, Louisiana Leasing Company (plaintiff), brought an action to evict the Sokolows from the premises.
