Facts
Lovelace (plaintiff) was an untenured professor at Southeastern Massachusetts University (defendant). Students complained to university officials that Lovelace’s courses were too hard and that his homework assignments were too time consuming. As a result of student complaints, and after consultation with Lovelace, the university decided to upgrade the lower-level courses taught by Lovelace. After Lovelace’s first year at the university, his contract was not renewed for a second year. Lovelace filed a lawsuit against the university, alleging that his First Amendment rights were violated. The district court dismissed Lovelace’s case, and Lovelace appealed.
