Facts
Harold Lovgren (plaintiff) obtained a second mortgage on his farm from Citizens First National Bank of Princeton (bank) (defendant). When Lovgren fell behind on his payments, several bank employees urged him to sell the farm. Lovgren refused. Advertisements then appeared in a newspaper stating that Lovgren would sell his farm at a public auction. But the bank had not initiated any foreclosure proceedings, nor had Lovgren agreed to sell his farm. Lovgren sued the bank for invasion of privacy. The bank moved to dismiss for failure to state a claim, which the trial court granted. Lovgren appealed.
