Facts
The City of Hazleton, Pennsylvania passed two ordinances in response to thousands of immigrants moving to the city. The first ordinance, the “Illegal Immigration Relief Act” (IIRA) prohibited the employment or harboring of illegal aliens within the city. The second ordinance, the “Tenant Registration Ordinance” (RO), required apartment dwellers to prove their citizenship or lawful resident status to obtain an occupancy permit. A group of immigrants containing both lawful residents and undocumented aliens (plaintiffs) sued in federal district court for an injunction to halt the ordinances from going into effect.
