Facts
Michelle Grosse (defendant) hired Lucas Nursery and Landscaping, Inc. (plaintiff) to perform landscaping work at her home. Grosse was dissatisfied with Lucas’s work. Grosse registered the domain name lucasnursery.com and created a website for the sole purpose of relaying her story and her dissatisfaction. Lucas did not have a website or a registered trademark for “Lucas Nursery.” Lucas sued Grosse under the Anti-Cybersquatting Consumer Protection Act (ACPA). The district court granted Grosse’s motion for summary judgment. Lucas appealed.
