Facts
In November 1962, two amendments to the Colorado Constitution relating to apportionment of state legislators were considered. Amendment No. 7 proposed apportioning state representatives based on population but maintained the existing system of apportionment of state senators, which combined population with other factors. Amendment No. 8 proposed apportioning the state house and senate based solely on population. Amendment No. 7 was adopted by the voters, and Amendment No. 8 was rejected. Amendment No. 7 was challenged as a violation of the Equal Protection Clause of the Fourteenth Amendment.
