Facts
Luck’s Music Library (Luck’s) (plaintiff) filed suit in the district court, challenging the constitutionality of § 514 of the Uruguay Round Agreements Act (URAA), which implemented Article 18 of the Berne Convention. Luck’s argued that the act violated the Copyright and Patent Clause of the United States Constitution by wrongfully taking certain works out of the public domain. Luck’s argued that taking works out of the public domain does not advance the causes of art or science because doing so would not provide any incentive to create new works or inventions. The district court dismissed Luck’s suit, and Luck’s appealed.
