Facts
Marvin Luttrell (plaintiff) was employed by United Telephone System, Inc. (United) (defendant). Another employee told Luttrell’s supervisor that Luttrell had been illegally taping phone conversations and that he had continued to do so even after being told to stop. Within the scope of his employment, Luttrell’s supervisor communicated the same information to two other supervisory employees. Luttrell filed a defamation suit against United, and United filed a motion to dismiss, claiming that the communications had not been published. The trial court granted United’s motion, and Luttrell appealed.
