Facts
The Commonwealth of Virginia dredged an inlet to improve navigation. The Commonwealth took the sand from the dredging and added it to an unrelated beach, increasing the size of the beach and cutting off Lynnhaven Dunes Condominium Association’s (plaintiff) connection to the water. The association sued the City of Virginia Beach (defendant), arguing that the association was entitled to compensation for its loss of riparian rights on the beach. The court ruled in favor of the city, and the association appealed to the Virginia Supreme Court.
