Facts
Maccabi Health Service and three other health funds (the health funds) (plaintiffs) sued Israel’s minister of finance (defendant) for failure to grant additional funds for the national health budget. The national Health Council had recommended an increase to the national health budget based on increasing population, increasing cost of technology, and additional services required to be covered. The minister did not address the merits of the recommended increase, instead stating that the increase would be denied based on budgetary reasons. The health funds asked the court to declare the minister’s decision invalid.
