Facts
Pizza of Gaithersburg, Inc. (Pizza) (defendant) and three other corporations under common ownership arranged to have vending machines installed in each of their locations by Virginia Coffee Service (Virginia) through contracts for terms of one year. The leases provided that they renewed automatically unless a party gave thirty days' written notice. Virginia’s assets were purchased by Macke Company (plaintiff) and the contracts were assigned to Macke by Virginia. Pizza tried to terminate the contracts, and Macke brought suit for damages and breach of contract. The court found for Pizza and Macke appealed.
