Facts
Felix Magierowski (plaintiff) was the father of Stephanie Magierowski. Stephanie was 21 years old, was living with her father, and had been employed for over two years. Felix filed suit against Buckley (defendant) claiming that Buckley had seduced Stephanie under the promise of marriage and Stephanie had become pregnant. Felix claimed damages for the loss of Stephanie’s earnings and services. Felix also requested punitive damages for medical expenses and for Stephanie’s shame, humiliation, and nervous shock. Buckley claimed that under N.J.S. 2A:23-1 et seq., commonly known as the Heart Balm Act, Felix was barred from suing for loss of service because Stephanie was no longer a minor child. Buckley filed a motion for summary judgment, and the trial court granted his motion. Felix appealed.
