Maine v. Superior Court
Supreme Court of California
438 P.2d 372 (1968)
- Written by Richard Lavigne, JD
Facts
Maine (defendant) and a codefendant were charged in connection with a murder in a small community. Maine moved for a change of venue on grounds that various factors, including publicity related to the murders, would deny him the opportunity to receive a fair trial in the local courts. The trial court denied Maine’s motion and Maine petitioned the state supreme court for a writ of mandamus.
