Facts
Eyob Mamo (defendant) was the sole shareholder of DAG Petroleum III, Inc. (defendant) and had operated a gas station and convenience store franchise on Good Hope Road since 1996. In 2004, the District of Columbia (plaintiff) initiated condemnation proceedings to obtain title to Mamo’s land through eminent domain in order to construct a municipal office building. The District of Columbia asserted that Mamo was only entitled to $680,000 as the fair market value of the land. Mamo asserted that he was also entitled to compensation for his franchise, business, and goodwill. The trial court found in favor of the District of Columbia, and Mamo appealed.
