Facts
Landmark 4, LLC (Landmark) (defendant) operated oil and gas wells in the vicinity of Medina Township, Ohio. Landmark’s drilling operations included the use of hydraulic fracturing (also known as fracking)—a process by which toxic chemicals were injected underground for purposes of natural-gas extraction. Various residents of the township (the residents) (plaintiffs) brought suit in federal district court. The suit’s various claims included one for strict liability, which Landmark sought to dismiss on the ground that the residents had failed to address all six strict-liability factors in the Restatement (Second) of Torts § 520.
