Facts
Manitowoc Western Company, Inc. (Manitowoc) (plaintiff) filed suit against Allen Montonen (defendant) in Wisconsin state court, asserting claims involving a contract dispute between the parties. Manitowoc was a Wisconsin corporation, and Montonen was a California resident who worked for Manitowoc in California. Before filing suit, Manitowoc invited Montonen to Wisconsin to discuss their disagreement. Manitowoc filed suit against Montonen that day, and it served Montonen with process at the end of the meeting. Montonen moved to set aside the process and for a declaration that the court lacked personal jurisdiction. Montonen argued that the fraud exception to transient jurisdiction should be extended to include circumstances in which the defendant was only in the forum state for settlement discussions. The trial court denied Montonen’s motion and granted summary judgment in favor of Manitowoc. After the appeals court affirmed, Montonen appealed to the Wisconsin Supreme Court.
