Facts
Investigators for Twin Falls Clinic & Hospital, Inc. (hospital) (defendant) concluded that the negligence of the hospital’s nurses played no role in the death of one of the hospital’s patients. The hospital took no disciplinary action against the nurses and retained the nurses on its staff. However, the hospital revised its policies to prevent the nurses’ negligence from happening again. The patient’s widow, Margarita Manning (plaintiff), disputed the investigators’ findings and sued the hospital. The trial jury returned its verdict for Manning. Because the court found that the hospital impliedly ratified its nurses’ negligence by keeping the nurses on the hospital’s payroll, the court included punitive damages in its judgment. The hospital appealed to the Idaho Supreme Court.
