Facts
The City of Stow, Ohio (the city) (defendant) enacted a zoning ordinance that imposed numerous safety requirements on single-family homes occupied by individuals with developmental disabilities. The ordinance did not impose these requirements on single-family homes with nondisabled occupants. Moreover, all the safety requirements applied to all single-family homes with developmentally disabled occupants, such that the ordinance did not tailor the requirements to specific types of developmental disabilities. Marbrunak, Inc. (plaintiff), a nonprofit corporation that provided housing for developmentally disabled individuals, brought suit against the city, contending that the ordinance violated the Fair Housing Act (FHA). The district court ruled in favor of Marbrunak. The city appealed.
