Facts
Marchisio (plaintiff) sued Carrington Mortgage Services, LLC (defendant) for repeatedly failing to accurately report the status of Marchisio’s mortgage loans. Specifically, the loans had been settled between the parties, but Carrington continued to report that Marchisio owed Carrington money. When Marchisio disputed the loan information, a Carrington employee simply checked financial databases used by Carrington. Because these databases never received information regarding the loan settlements, Carrington continued to report that Marchisio owed money when he did not. The court ruled that Carrington’s investigation was not reasonable as a matter of law but found that Marchisio was not entitled to punitive damages or damages for emotional distress. Both Carrington and Marchisio appealed.
