Facts
A dispute arose between Maritime Int’l Nominees Establishment (MINE) (plaintiff) and the Republic of Guinea (defendant) regarding a joint venture between the parties. The parties agreed to pursue dispute resolution through arbitration before the International Centre for Settlement of Investment Disputes (ICSID). Thereafter, MINE commenced arbitration proceedings before the American Arbitration Association, through which it obtained an award, and MINE sought enforcement of the award in various countries’ courts. MINE also commenced arbitration proceedings before the ICSID. The ICSID arbitral tribunal entered an interim award directing MINE to cease all proceedings outside of the ICSID arbitration proceedings. MINE sought intervention from the Swiss court.
