Mark J. Mills v. Rubie Rogers
United States Supreme Court
457 U.S. 291 (1982)
- Written by Monica Rottermann , JD
Facts
On April 27, 1975, Rubie Rogers (plaintiff) and other patients institutionalized at Boston State Hospital filed suit against Mark J. Mills (defendant), state official of the hospital, in federal district court. Rogers argued that being forcibly given antipsychotic drugs violated her constitutionally protected rights. Both parties agreed that patients have a constitutionally protected right to refuse antipsychotic drugs, but Mills argued that state interests may outweigh the individual patient’s rights. Mills sought review in the United States Supreme Court.
