Facts
Julie Marquette (plaintiff) requested an emergency ex parte temporary restraining order against her ex-husband, Jeff Marquette (defendant). Under the Protection from Domestic Abuse Act, such an order could be granted so long as the defendant received a full hearing within 10 days. Julie claimed that Jeff had abused her and their young children. The trial court granted the order, and Jeff was effectively denied his right to visit his children for over two weeks because he could not communicate with Julie. Jeff appealed the ex parte order to the Oklahoma Court of Appeals, arguing that the order violated his due-process rights.
