Facts
Steven Richard Marquiz (defendant), Rudy Gallegos (defendant), and Antonio Laroza (defendant) induced seventeen-year-old Debra Terhorst to go with them to Lookout Mountain. While there, the men stabbed Terhorst several times and cut her throat, killing her. All of the defendants were charged with first-degree murder and conspiracy to commit first-degree murder. The cases were severed for trial. A jury found Gallegos guilty of first-degree murder, but not guilty of conspiracy to commit first-degree murder. A separate jury found Laroza not guilty on both charges. Finally, a jury found Marquiz guilty on both counts. Marquiz appealed.
