California Court of Appeal
64 Cal. Rptr. 29 (2007)
- Written by Sean Carroll, JD
Facts
Aaron Feldman (defendant) and Elena Feldman (defendant) were married. Elena filed a petition for dissolution of the marriage. During the dissolution proceeding, Aaron failed to disclose certain financial transactions associated with his business. Aaron’s assets were valued at approximately $50 million. Elena filed an application seeking payment of her attorney fees and imposition of sanctions on Aaron due to his breach of his fiduciary duty to disclose all of his assets and liabilities, both separate and community, during the proceeding. The trial court issued an interlocutory order, ordering Aaron to pay $250,000 in sanctions and $140,000 for Elena’s attorney fees. Aaron appealed.
