Facts
Cindy Hebbring (plaintiff) and Jess Hebbring (defendant) were married without children when Cindy filed for divorce. In response to the issuance of a temporary restraining order that prevented Jess from selling or otherwise disposing of Cindy's separately owned jewelry, Jess informed the court that he had thrown Cindy's jewelry into the sea. In the divorce action, the trial court determined that Cindy's jewelry was worth $5,000.00 and ordered that amount be taken from Jess' share of community property to reimburse Cindy for the loss of her separate property. Jess appealed the trial court's decision.
