Marriage of Watts
Court of Appeal of California
217 Cal. Rptr. 301 (1985)
- Written by Sean Carroll, JD
Facts
Dr. John Watts (defendant) and Carol Watts (plaintiff) were married. Approximately four months before the wedding, John left his job at a hospital and started his own medical practice. Almost four years later, Carol filed a petition for dissolution of the marriage. At trial, John’s expert witnesses testified that because John’s medical practice could not be sold, it had no goodwill. In calculating the distribution of community assets, the trial court found that John’s medical practice had no goodwill. Carol appealed.
