Facts
Goodyear Tire & Rubber (Goodyear) (defendant) fired William G. Reed, Jr. in violation of the Age Discrimination in Employment Act of 1967 (ADEA). The Secretary of Labor (plaintiff) sued Goodyear for that violation and sought damages for Reed’s lost wages and an injunction against further violations of the ADEA. Some evidence was also presented regarding a discriminatory job order placed by a Goodyear store in Lakeland. The district court found one violation of the ADEA based on the termination of Reed by the manager at Goodyear’s Auburndale store. The district court did not make a finding of a discriminatory company policy or practice. The district court entered a nationwide injunction against further violations of the ADEA. Goodyear appealed to the United States Court of Appeals for the Fifth Circuit.
