Facts
Shelly Martin (plaintiff) brought a claim against her employer Atlanticare (defendant) for retaliation and violations of state and federal labor laws. Martin was represented by Kevin Costello of the law firm of Costello & Mains. Atlanticare was represented by three attorneys, Richard Rosenblatt, Lisa Grosskruetz, and Prashanth Jayachandran, all from the Morgan law firm. Grosskruetz worked almost twice as many hours on the matter than the other members of the defense counsel team, including legal research, document preparation, communicating with opposing counsel, and interviewing witnesses. After approximately 3 months of working for Morgan, Grosskruetz left the firm on March 4. On March 7, Grosskruetz began employment with Costello & Mains. Atlanticare and the remaining defense counsel learned of Grosskruetz’s side-switching new employment when they noticed her name on Costello & Mains’ letterhead. Atlanticare filed a motion to disqualify Costello & Main from representing Martin based on an imputed conflict from Grosskruetz. Grosskruetz left employment with Costello & Mains on the day the motion was filed.
