Martin v. Ryder Truck Rental, Inc.
Delaware Supreme Court
353 A.2d 581 (1976)
- Written by Sharon Feldman, JD
Facts
Ryder Truck Rental, Inc. (Ryder) (defendant) leased a truck to Gagliardi Brothers, Inc. (Gagliardi). A Gagliardi employee was driving the truck when the braking system failed. As a result, the truck failed to stop at a traffic light and struck the rear of another automobile, causing that vehicle to collide with the vehicle driven by Dorothy Martin. Martin was injured, and her car was damaged. Martin and her husband (the Martins) (plaintiffs) sued Ryder based on the doctrine of strict tort liability. The superior court granted summary judgment to Ryder, holding that strict liability in tort was not applicable to a bailment-lease. The Martins appealed.
