Facts
Luis A. Martinez-Bodon (plaintiff) filed a claim for a service-connected disability based on diabetes mellitus and a mental condition secondary to diabetes mellitus. The Department of Veterans Affairs (VA) (defendant) regional office gave Martinez-Bodon a 20 percent disability rating for diabetes mellitus, but it denied any service connection for the mental condition. The regional office based the denial on a VA examiner’s finding that Martinez-Bodon’s anxiety did not qualify as a mental condition under the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition (DSM-5). Martinez-Bodon appealed to the Board of Veterans’ Appeals, which denied a service connection. Martinez-Bodon appealed.
