Facts
Jason Mashaney (plaintiff) was convicted of sodomy and other related crimes. He had been represented by the Board of Indigents’ Defense Services (the board) (defendant). More than seven years later, the conviction was vacated. Mashaney entered an Alford plea, pleading guilty to lesser charges. Mashaney sued the board for legal malpractice. The appellate court required Mashaney to prove affirmatively that he was innocent of the underlying crimes. Mashaney appealed.
