Facts
Hodge Mason (plaintiff) was a mapmaker. At issue was a map Mason had made of Montgomery County. Mason’s map identified things such as tract shapes and sizes, land grants, topography, and a host of other information. Montgomery Data Incorporated (Montgomery) purchased one of Mason’s maps and used the map in its land-indexing system. Montgomery’s use involved overlaying the map with a transparency and adding updates to the information. Mason sued Montgomery in federal district court for copyright infringement. Mason argued that his map was a result of his creative expression, but the district court found for Montgomery. Mason appealed to the Fifth Circuit.
