Facts
Admiral Emilio Massera (defendant) was part of a brutal military junta that controlled Argentina (plaintiff) from 1976 to 1982. After the junta’s fall, Argentina prosecuted the junta members for crimes against humanity, including the forced disappearance of people. Massera, among others, was convicted. He appealed the conviction to the Argentina Federal Appeals Court, arguing that the statute of limitations barred the prosecution.
