Facts
The investors (Masters) (plaintiffs) of GlaxoSmithKline (Glaxo) (defendant) commenced a class-action lawsuit against Glaxo for violation of § 10(b) of the Exchange Act. Prior to the commencement of this suit, Glaxo had been sued on several different occasions between 2001 and 2003, regarding misstatements related to several of its prescription drugs. The district court dismissed Masters’ claim, stating that the statute of limitations had run. Masters then appealed to the Second Circuit Court of Appeals.
