Facts
Hukla Germany SA (Hukla) (defendant) registered the word “matratzen,” the German word for mattress, as a trademark in Spain in 2004 to refer to its line of mattresses. Matratzen Concord AG (Matratzen) (plaintiff) thereafter sought a trademark for the word matratzen and brought an action in Spain seeking to have Hukla’s trademark canceled. The Spanish district court rejected Matratzen’s action, and Matratzen appealed to the Barcelona Provincial Court, which then referred the legal question concerning the trademark registration of a generic word to the European Court of Justice.
