Facts
An attorney (defendant) represented an organization that employed AB (plaintiff). AB was involved in a domestic dispute with her husband. AB’s husband told police that AB had threatened to harm him. AB called the attorney to discuss the dispute and her husband’s allegations and told the attorney that she and her husband were separating. AB soon thereafter called the attorney again to request a referral for a family-law lawyer. The attorney referred AB to another lawyer in her firm. AB retained that lawyer, who AB directed to file a divorce petition, of which the attorney was aware. AB and her husband soon reconciled, the divorce petition was withdrawn, and AB ended her client relationship with the firm. The attorney was unaware of AB’s reconciliation with her husband. A few months later, the attorney told a mutual friend about AB’s divorce filing and AB’s husband’s accusations that AB had threatened him. The attorney encouraged the friend to contact AB after the friend displayed concern. When the mutual friend told AB about the attorney’s disclosure, AB filed a grievance against the attorney.
