Facts
Artee Corporation (Artee) (petitioner), a company that provides temporary help to technically oriented firms, sought to classify a group of workers as machinists under § 101(a)(15)(H)(ii) of the Immigration and Nationality Act, which grants temporary visas for workers coming to the United States to perform temporary service or labor. The only issue for review was Artee’s “temporary” need for the services of the machinists. The Regional Commissioner had examined the need for machinists based on Artee’s customers, and determined that because there was a shortage of machinists in the United States, the need for the employment was permanent, not temporary. On appeal, the Commissioner reviewed the decision of the Regional Commissioner.
