Facts
Farber (defendant) was a reporter for the New York Times. Farber’s investigation into the criminal activity of Mario Jascalevich contributed to Jascalevich’s prosecution and subsequent trial for murder. The court in the murder trial ordered Farber to produce materials compiled in his investigation into Jascalevich. Farber declined to produce his investigative materials and was charged with contempt of court. Farber was found guilty of contempt, sentenced to jail, and appealed.
