Facts
Wisconsin resident Gerald Geise Jr. (debtor) had a personal-injury action pending when he filed for bankruptcy. Geise elected to take state instead of federal exemptions and listed the personal-injury action as exempt from property of the estate. The bankruptcy trustee objected because no Wisconsin statute exempted personal-injury actions or their proceeds when Geise filed bankruptcy. The bankruptcy court found no exemption applied, and the district court affirmed. Weise appealed.
