Facts
New York attorney Rudolph Giuliani (defendant) represented former president Donald Trump in connection with Trump’s claim that the 2020 presidential election was stolen from Trump. The New York Attorney Grievance Committee (AGC) (plaintiff), which was investigating Giuliani, filed a motion for his immediate interim suspension. Among other things, the AGC claimed that during a federal court hearing attended by several thousand members of the public, Giuliani represented that Trump was pursuing a fraud claim despite the fact that the operative complaint contained no fraud count. Ultimately, Giuliani admitted that the operative complaint did not allege fraud, but only after extensive questioning from the court. The AGC further asserted that Giuliani knowingly made false statements to the public regarding voting by illegal immigrants, deceased people, and minors. Giuliani continued to make similar false statements after the AGC moved for interim suspension.
