Facts
S-P- (plaintiff) was a Sri Lankan man who was taken from his home in a refugee camp in northern Sri Lanka during a time of civil conflict. S-P- was taken by a group that opposed the government, and he was forced to work as a welder in one of their camps. The group was known as the Liberation Tigers of Tamil Eelam (Tigers). In March 1994, the Sri Lankan Army attacked the camp and captured S-P- and 12 other workers who had been conscripted. The soldiers thought that S-P- and the other workers were also Tigers, so they were imprisoned, threatened, and beaten over the course of six months. S-P-’s uncle secured S-P-’s release by bribing a guard. However, eight days later, three police officers came looking for S-P-. S-P- left Sri Lanka a few months later and applied for asylum in the United States.
