Facts
Shauna and Darryl Thurgood had one child, S.T.T., when they divorced. Shauna was S.T.T.’s custodial parent until Shauna died. Then S.T.T. went to live with her maternal grandmother, Darlene Uzelac, who petitioned for custody as S.T.T.’s guardian. After seeing his ex-wife’s obituary, Darryl also petitioned for custody. The court awarded temporary custody to Darryl but ordered visitation with the Uzelacs one weekend per month until trial. Darryl did not cooperate, and the court held him in contempt. Darryl filed a motion to relieve him from the contempt order under Utah Rule of Civil Procedure 60(b). The court refused and sentenced him to 60 days in jail, which he could avoid only by producing S.T.T. for visitation twice monthly until trial. Darryl appealed.
