Facts
Vincenti (defendant) represented D.K in a child abuse and neglect case. A local ethics committee (plaintiff) filed a 22-count ethics complaint based on Vincenti’s in-court and out-of-court conduct throughout his representation of D.K. Specifically, Vincenti accused the court of collusion, racism, and cronyism, and frequently acted disrespectfully and irrationally. On one occasion, Vincenti reviewed a witness’s documents and refused to return them despite repeated requests to do so. Additionally, Vincenti sent a sarcasm-laced letter to the trial judge, accusing the judge of being irrational and partial. Vincenti engaged in further disrespectful conduct directed towards witnesses, opposing counsel, and other attorneys, including name calling, the use of obscenities, and even physical pushing. Vincenti unnecessarily subpoenaed individuals for testimony, and on at least one occasion attempted to intimidate a witness. The Disciplinary Review Board affirmed the ethics committee’s conclusions about Vincenti’s unethical conduct. Vincenti appealed to the New Jersey Supreme Court.
