Maughs v. Porter
Virginia Supreme Court
161 S.E. 242 (1931)
- Written by Sara Rhee, JD
Facts
H.P. Porter (defendant) published an advertisement inviting the public to attend an auction for residential lots. The advertisement announced that attendees would be eligible to enter a drawing to win a new car. Mrs. N.S. Maughs (plaintiff) attended the sale and won the drawing. However, Porter refused to deliver the car or to pay Maughs the value of the car. Maughs brought suit to recover the value of the car. Porter filed a demurrer, which the trial court sustained. Maughs appealed.
