Facts
A dispute arose between a Russian national, Nikolai Maximov (plaintiff), and NLMK (defendant), a Russian enterprise, about the purchase price of corporate shares. The parties submitted the dispute to arbitration in Russia, and Maximov obtained an award in his favor. A Russian court then set aside the award on the grounds that two arbitrators failed to disclose their relationships to expert witnesses, the dispute was not subject to arbitration under Russian law, and the calculation of the award was contrary to Russian sales law. Maximov nevertheless sought to enforce the award in the Netherlands. The lower courts refused enforcement, and Maximov appealed to the Netherlands Supreme Court.
